HEALTH GUARANTEE I guarantee the health of dog to be free of infectious diseases (Parvo, Distemper, ect.) at the time of purchase. I also warrant that dog has not knowingly been exposed to any illness or disease, or any dog showing signs of illness or disease, in the 21 days prior to buyer taking possession of dog. Buyers Responsibility; To establish that Buyer and their veterinarian of choice agrees that the purchased dog was healthy at the time of purchase. Buyer is required by breeder to take dog to a veterinarian of buyer choice, at buyers expense, with 48 hrs. (two normal business days) of transfer. Buyer must notify breeder of any covered problem found by the veterinarian within 24 hours of exam. If buyer fails to have dog evaluated by a licensed veterinarian within two normal business days of transfer buyer agrees dog to be healthy. If buyer fails to inform breeder within 24 hours of any found illnesses, or diseases this health guarantee is null and void. Buyer should be aware that the stress of being transferred from breeder’s home can sometimes trigger signs of illness in an otherwise health dog. This does not mean that the dog was unhealthy even if they require veterinary care. Stress related problems: 1- Diarrhea can sometimes be bloody, vomiting and listlessness can all be signs of stress. (It is highly recommended by breeder not to show off puppy, take out in public, for at least a week.) This will minimize the stress on dog. Let the dog have time to settle in to you and your environment. 2- Changes in food and even water can also trigger signs of illness. Keep puppy on same food as fed by breeder and bottled water. If you desire to change food and water fed by breeder, do this slowly by adding small amounts of old food to new food over a one week period. 3- Stress also can affect the dogs immune system to the extent that normal environmental factors like Giardia and Coccidia can suddenly flourish unchecked within the dogs system and can cause these same signs of illness. 4- It is not uncommon to find a dog with worms even if it has been wormed by breeder and does not mean that dog is unhealthy. Breeder warrants that dog to be free of life-threatening genetic defects for one year from the date of purchase. A life threatening defect is defined as: 1- A genetic defect, diagnosed by two separate, individual practicing veterinarians as being sufficiently serious to warrant immediate euthanasia of the dog, or 2- A genetic defect that is likely to cause the death of the dog within 6 months. Breeder shall not be responsible for any expenses associated with diagnosis, treatment or care regarding a covered defect. Breeder warrants that said dog will pass an OFA (Orthopedic Foundation for Animals) hip evaluation at 2 years of age with a rating of “Fair” or better. 1- OFA evaluation must be performed between 24 & 26 months of age. 2- Breeder must be notified of a failed exam with 14 days of the OFA certification date. 3- Preliminary OFA x-rays can be done at 12 and 18 months of age but, in the event these x-rays show abnormal hip development, it is Breeder’s option whether to take these early findings as an actual diagnosis of hip-dysphasia. Breeder shall not be held responsible if puppy should develop (cherry eye) as this can be cause by environimental factors. If any covered defect or illness is diagnosed by a licensed, practicing veterinarian during the period covered by this guarantee, breeder shall have the right to have dog examined, at Buyer’s expense, by a specialist or Breeder’s veterinarian of choice, to verify any alleged defect/illness. If said dog should prove to be “diseased” or “defective” and Buyer notifies Breeder as outlined above, Breeder agrees to replace the dog with one of equivalent quality as specified below. 1- If purchased dog was a puppy under 6 months of age, replacement will be from the first litter bred by the Breeder with an available puppy of similar value. 2- If purchased dog was over 6 months of age, a replacement will be a dog of comparable age and value if avaliable. 3- Buyer acknowledges that, due to genetic factors and varying breeding practices, breeder cannot guarantee to be able to provide an exact match of color and/or sex should a dog need to be replaced. Breeder shall make every effort to offer buyer a replacement of similar type and color, but cannot guarantee and exact replacement. 4- At breeders option, breeder may refund the original purchase price less non-refundable $350.00 deposit. Buyer is required to provide immediate veterinary care to any puppy/dog showing signs of illness or distress. Failure to provide adequate or proper veterinary care will render any guarantee null and void. The original dog purchased must be returned to breeder to receive a replacement puppy or refund. 1- Buyer must provide any care necessary to support an ill/defective dog until it is returned to breeder or until breeder authorized that the dog be euthanized. 2- Dog must be returned to breeder in good condition - clean, groomed, current vaccines, worming and heartworm preventative (as appropriate for the situation) and the dog must be free of external parasites. 3- Buyer must sign off of AKC registration papers and paperwork at time of return of dog or dog will not be accepted. No replacement puppy will be replaced until all paperwork is received. 4- At no time is money to be refunded or exchanged made unless the following requirements have been met: 1- Health Problems (contagious, infectious, genetic or hereditary): A statement from the examining Veterinarian(s), is necessary for the return of any puppy or dog. The statement shall include the name and address of the examining veterinarian, name of dog, owner’s name, date of exam(s), precise findings, treatment(s) recommended and/ or carried out. 2- If a dog is returned for any reason, a copy of its complete health Record (showing all care, treatments, vaccinations, etc.) must be brought or sent prior to the return of the puppy/dog. NO DOG WILL BE ACCEPTED BACK INTO THE KENNEL WITHOUT THIS PAPERWORK. If purchased puppy should die suddenly during the period covered by this guarantee and if it is believed that the death is due to genetic defect or illness covered by this agreement, then buyer must follow the directions below. 1- An autopsy MUST be preformed. 2- Necropsy results must show the dog died of a genetic defect or covered illness/disease and that the death was NOT due to an injury, accident, ingestion of poison or non food item, or due to a lack of proper/adequate care/supervision (by buyer or caregiver or their veterinarian). 1- Death due to illness, parasites, neglect or any preventable/treatable issue (whether the death was due to improper diagnosis or treatment; or due to a lack of appropriate care/ treatment; or due to a lack of Preventive care/maintenance) is NOT covered, regardless of whether the fault lies with the buyer or the veterinarian. 2- Death due to defect resulting from disease or injury or as a result of medication, treatment, supplement, care or diet (whether a product or prescribed by Buyer’s veterinarian or given by Buyer or caregiver without a veterinary medical practitioner’s input), is Not covered. 3- Breeder must be notified of the purchased dog’s death within 48 hours of death and must receive a copy of ALL veterinarian records related to diagnosis, treatment and care of the issue that led to the death of the dog and must also receive copies of autopsy/necropsy results. 1- Copies of veterinary records must be presented to Breeder within 48 hours of final necropsy report. 2- Buyer must provide Breeder with authorization and permission to discuss and review all veterinary Medical records and findings with all treating veterinarians, including those doing the autopsy/ necropsy. 3- Buyer shall instruct the facility handling the dog’s remains that, said remains are not to be destroyed until Breeder is satisfied as to the cause of death. 4- If Breeder feels that final results of necropsy are questionable, inconclusive or ambiguous. Buyer agrees to order additional testing or a second opinion (at buyer’s expense), as requested by Breeder. Buyer acknowledges that the place of purchase of puppy was Breeder’s address and, therefore, any travel arrangements or expenses for picking up a puppy, the return of a defective puppy or delivery of a replacement puppy will be buyer’s responsibility. Buyer acknowledges that once the dog has been removed from the Breeder’s premises, the Breeder has no control over the dog’s environment, care, or safety. Buyer hereby agrees that Breeder cannot be held responsible for illnesses, infections or parasites the dog my have contracted or been exposed to after removal from Breeder’s care. Likewise, any accidents or injuries to purchased dog, suffered during or after delivery, are the sole responsibility of Buyer. Buyer, acknowledges that they are aware That vaccines are not 100% effective in every dog and that it is possible for vaccinated dog to become ill from an infectious disease, even if it has received vaccines for that disease. Seller advises that, especially with young puppies, care should be taken to not expose the purchased dog to other dogs with questionable vaccination records or circumstances that could expose the purchased dog to illness or disease, until all vaccinations are completed. I.e. (Boarding Kennels, Pet Shops, Public Parks) Buyer also acknowledges that they are aware that some dogs may have adverse reactions to vaccines, and that these reactions to vaccines, can be delayed by several weeks. Buyer accepts that C-Ray Kennel is not responsible for any abnormal or allergic reactions a dog or puppy may have to vaccines, whether the dog was vaccinated by C-Ray Kennels or another party. I have read and understand________________________________________ Date__________________________________ Buyer(s) agrees that in the event he/she/they are unable, at any time, to provide purchased dog with proper care or permanent home, the dog will be returned to C-Ray Kennels. Said dog may not be sold, bartered, given away, or surrendered to a shelter or a rescue organization or otherwise transferred to another party without the express written consent of C-Ray Kennels. This health guarantee is limited to the original purchaser(s) or agent of the dog. Original purchases is the person that arranged the purchase of the dog in question and/or the person that took actual physical possession of the dog. Breeder’s liability in this transaction is always limited to the purchase price of said dog, less non-refundable $350.00 deposit. If it is discovered that purchased dog has not received proper care from Purchaser - adequate/appropriate food, water, exercise, grooming, preventive/necessary veterinary care or if all conditions of purchase/ownership contract has not been fulfilled - health guarantee is null and void. This agreement is to be construed under the laws of the State of Georgia or the state the seller is currently a resident in. Each party hereby acknowledges that he/she had an opportunity to review this Guarantee and Agreement, including the opportunity to consult with an attorney if he/she so chooses and that this Agreement is entered into knowingly, voluntarily, and with an understanding of the terms hereof. This is the entire Health Guarantee and Agreement for the purchased dog and no other warranties or guarantees, expressed or implied, are applicable. The buyer(s) and Cathy Todd, C-Ray Kennel, or one of its agents, have read and understand this agreement and agree to all parts and portions thereof and consider it binding agreement.
